Where an applicant has unsuccessfully sought review before the Migration Review Tribunal (“MRT”) or the Refugee Review Tribunal (“RRT”), then the applicant may, as a last resort seek direct intervention from the Minister for Immigration and Border Protection to substitute a more favourable decision.
The Minister may substitute a more favourable decision, if the Minister considers that it is in the public interest to do so. Ministerial intervention occurs only on rare occasions and unique or exceptional circumstances must be present.
For any application to be undertaken from Ministerial intervention, a great deal of planning and detail needs to be put into the application.
